By accessing or using the Legacy Leads platform ("Service"), operated by Legacy Leads LLC, a Delaware limited liability company, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
Legacy Leads provides a subscription-based platform that delivers real estate lead data, including but not limited to property owner information, contact details, property data, and estimated property values. Leads are generated from publicly available data sources and third-party data providers.
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By using the Service, you represent that you meet these requirements. The Service is intended for use by licensed real estate professionals, investors, and other qualified individuals in the real estate industry.
To access the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account.
The Service is offered on a monthly subscription basis. Pricing is determined on a per-county basis and varies based on lead volume in each county. By subscribing, you authorize us to charge your designated payment method on a recurring monthly basis. All fees are non-refundable unless otherwise stated. We reserve the right to modify pricing at any time with reasonable notice.
You may add or remove counties from your subscription at any time. Changes will be reflected in your next billing cycle. You may cancel your subscription at any time, and your access will continue through the end of your current billing period.
You agree to use the Service and any data provided only for lawful purposes and in compliance with all applicable federal, state, and local laws and regulations, including but not limited to:
You are solely responsible for ensuring your use of leads and contact information complies with all applicable laws, including DNC list compliance. Legacy Leads does not scrub leads against the National Do Not Call Registry or any state-specific DNC lists. It is your responsibility to perform DNC compliance checks before initiating any outreach.
Legacy Leads makes no warranties or guarantees regarding the accuracy, completeness, timeliness, or reliability of any lead data provided through the Service. Lead data is sourced from publicly available records and third-party data providers and may contain inaccuracies, outdated information, or errors. You acknowledge and agree that:
You agree that Legacy Leads shall not be liable for any losses, damages, or costs arising from inaccurate or incomplete lead data.
Legacy Leads does not guarantee any specific results, including but not limited to the number of deals closed, revenue generated, or return on investment from using the Service. The success of your outreach efforts depends on numerous factors outside our control, including market conditions, your communication approach, and local regulations.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEGACY LEADS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
In no event shall Legacy Leads' total liability to you for all claims arising out of or related to the Service exceed the amount you paid to Legacy Leads in the twelve (12) months preceding the event giving rise to the claim.
Legacy Leads shall not be held liable for any claims, fines, penalties, or damages arising from your failure to comply with applicable laws, including but not limited to TCPA violations, DNC violations, or any other regulatory infractions resulting from your use of lead data provided through the Service.
You agree to indemnify, defend, and hold harmless Legacy Leads LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any claims from third parties related to your use of lead data obtained through the Service.
The Service, including its design, features, content, and underlying technology, is owned by Legacy Leads LLC and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service for its intended purpose during your active subscription. You may not copy, modify, distribute, sell, or lease any part of the Service or its data, except as expressly permitted for your own direct business use (such as exporting leads for personal outreach).
You may not resell, redistribute, share, publish, or otherwise make available to third parties any lead data obtained through the Service. Lead data is licensed for your personal and internal business use only. Violation of this provision may result in immediate account termination without refund.
We reserve the right to suspend or terminate your account at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, fraudulent activity, or abuse of the Service. Upon termination, your right to access the Service and any data obtained through it ceases immediately.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered may be entered in any court having jurisdiction thereof.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
